In his proposed Senate Resolution No. 536, Pangilinan is urging a thorough examination of the agreement's consistency with the 2016 arbitral ruling, which recognized Ayungin Shoal as part of the Philippines' exclusive economic zone (EEZ).

Recent confrontations in the region have heightened concerns. Two Philippine Navy personnel were injured during an incident involving the China Coast Guard near the BRP Sierra Madre.
Retired Supreme Court Justice Antonio Carpio has advocated for the cancellation of the Ayungin Deal, emphasizing that the existing arbitral ruling should negate any necessity for such agreements with China.
In response, Chinese Ambassador Jing Quan expressed that activities surrounding the Sierra Madre violate the spirit of the provisional agreement, further complicating the diplomatic situation.
The Department of Foreign Affairs has stated its respect for the Senate's oversight role and is open to clarifying issues related to the Provisional Understanding.
