Prominent law deans and professors have issued a stark warning to the Senate, stating that refusing to hold an impeachment trial for Vice President Sara Duterte may expose senators to both administrative and criminal liability.

In a statement released on Monday, the legal scholars emphasized that the Constitution mandates the Senate to act without discretion once the House of Representatives transmits the approved impeachment articles.

The signatories, including retired Supreme Court Justice Adolfo Azcuna, pointed out that Article XI, Section 3 of the Constitution requires the trial to proceed immediately.

The statement criticized attempts by some senators to delay or derail the impeachment process, particularly following a recent leadership change in the Senate.

The group condemned what they termed the 'Escudero definition' of 'forthwith,' referencing former Senate President Francis Escudero's comments suggesting the Senate could determine the trial's timing.

'Refusal of public officers to perform a duty imposed by law constitutes dereliction of duty,' the statement asserted.

The legal experts also noted that delaying the trial could grant 'undue advantage' to the Vice President, potentially violating anti-graft laws.

They commended the House members who voted in favor of the impeachment complaint, acknowledging their courage in taking a stand.

The group additionally called for cooperation with international legal processes concerning Senator Ronald dela Rosa, currently facing scrutiny from the International Criminal Court.

The statement urged the public to ensure that all public officials uphold their constitutional duties and respect the rule of law.
