The International Criminal Court (ICC) has ordered a fresh medical examination for former President Rodrigo Duterte to determine his fitness for trial scheduled on November 30, 2026.

Assessing Fitness to Stand Trial

The Chamber requires an objective assessment of the Accused’s health by independent experts for the purposes of making a determination as to his fitness to stand trial.

ICC Trial Chamber III
  • Examination to assess any changes in Duterte's medical condition
  • Independent experts appointed to evaluate fitness for trial

The Trial Chamber III emphasized its obligation to evaluate Duterte's health status, stating that prior assessments were limited and did not adequately address the fitness for trial.

The ICC highlighted that the appointed experts should consider initial findings from previous evaluations while determining any changes in Duterte's health that may impact his ability to participate in the upcoming trial.

Moreover, the Chamber reiterated that fitness to stand trial hinges not merely on medical conditions but on the accused's capacity to exercise fair trial rights.

Duterte's request to add an unidentified individual to his list of non-privileged contacts was also granted by the ICC.

This latest order marks a significant step in the ongoing legal proceedings against Duterte, who faces allegations of crimes against humanity related to his controversial anti-drug campaign during his presidency.
