Legitimate vape sellers in the Philippines are calling for stronger government action against illegal trading practices. The Philippine E-Cigarette Industry Association (PECIA) highlighted the need for better enforcement of existing regulations at a recent Senate hearing.

PECIA president Joey Dulay emphasized that the issue lies not in the absence of laws but in their weak enforcement. He stated, "The market is flooded with unregistered, non-compliant illegal vape products. The real gap is not in the current law but in its enforcement."

Senate Hearing Highlights Concerns

The Senate hearing, led by Senator Risa Hontiveros, primarily focused on the accessibility of vape products to minors. Hontiveros reassured that the review of the Vape Law aims to protect public health and youth, not to harm the vaping industry.

This is not anti-industry. This is pro-health, pro-youth. This is not about product but about people.

Dulay pointed out that Republic Act No. 11900 already includes various safeguards, such as age restrictions and penalties for violators. He stressed the need for authorities to enforce these provisions against illegal traders who often ignore regulations.

Call for Balanced Regulation

Dulay differentiated between compliant businesses and illegal sellers, arguing that treating all vape vendors the same is unjust. He noted that illicit traders do not adhere to guidelines, undermining legal businesses and posing risks to youth.

PECIA represents over 300 companies and advocates for a balanced approach that protects minors while allowing legitimate businesses to thrive. Dulay stated, "The strongest protection for youth comes from strong enforcement of balanced regulation that removes illegal supply."

E-Commerce Platforms Join the Discussion

Representatives from major e-commerce platforms, including Shopee and Lazada, also attended the hearing. They pledged to improve coordination with regulators to prevent illegal listings and ensure compliance with safety standards.

We believe that enforcement is most effective when platforms and regulators operate from shared specific reference points.

As the discussion continues, stakeholders are hopeful that enhanced regulations and enforcement will help foster a safer marketplace for both consumers and legitimate businesses.
