The Department of Energy (DOE) has initiated legal proceedings against Leandro Leviste and directors of Solar Para sa Bayan Corp. (SPBC) for failing to execute their legislative franchise responsibilities.
Energy Secretary Sharon Garin has referred the matter to the Department of Justice, citing that SPBC has not launched any projects since it was granted a franchise in 2019.
The complaint asserts that while SPBC has not acted on its obligations, it has been generating revenue through other companies under Leviste's ownership.
The franchise permits SPBC to develop microgrids and harness renewable energy to supply electricity to underserved communities.
Background of the Franchise
SPBC received its franchise during the administration of former President Rodrigo Duterte, intended to expand access to renewable energy.
However, the Energy Regulatory Commission has indicated that SPBC may face penalties exceeding P150 million due to its alleged illegal charges.
When the legislative franchise was granted in 2019, SPBC had no single project or operation to speak of.

The DOE has previously imposed a staggering P24 billion penalty against Leviste's other company for failing to deliver promised renewable energy capacity.
